State of Punjab
...Respondent
CORAM: HON'BLE MRS. JUSTICE MANISHA BATRA
Present:- Mr. Amit Arora, Advocate
for the petitioner. Ms. Sakshi Bakshi, AAG, Punjab. MANISHA BATRA, J. (Oral)
1. Prayer in this petition, filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, is for grant of regular bail to the petitioner in FIR No. 0231 dated 03.10.2017, registered under Section 379-B of IPC (Section 201 of IPC added later on) at Police Station Bhikhiwind, District Tarn Taran. 2. As per the allegations, on 03.10.2017, two youths, who came while riding a bike, had snatched purse of the mother of complainant Balkar Singh by keeping a sharp edged weapon on the neck of the complainant and had escaped. The complainant identified both of them and one of them was the present petitioner. On his statement, the aforementioned FIR was registered. The petitioner was arrested. Subsequently, he was released on bail. He absented himself on 23.08.2022. His bail was cancelled. He was declared a proclaimed person on 30.09.2023 and was arrested on 02.02.2024. 3. It is argued by learned counsel for the petitioner that he is in custody since long. The conclusion of trial will take time. incarceration would not serve any useful purpose. It is, therefore, urged that the petition deserves to be allowed. 4. Status report has been filed by the respondent-State. Learned State counsel has argued that there are serious allegations against the petitioner. He was declared a proclaimed person. There are chances of his absconding again, if released on bail. Hence, it is urged that the petition is liable to be dismissed. 5. I have heard learned counsel for the parties at considerable length and have gone through the record. 6. The petitioner is in custody since 02.02.2024. Trial will take time to conclude since several witnesses are yet to be examined. Further incarceration of the petitioner is not going to serve any fruitful purpose. Taking into consideration the above mentioned facts, I am of the considered opinion that the present petition deserves to be allowed. Accordingly, the same is allowed.
The petitioner is ordered to be released on regular bail, subject to his furnishing personal bonds and surety bonds by two sureties to the satisfaction of the trial Court/Duty Magistrate concerned and on the following conditions:- (i) the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case or tamper with the evidence of the case in any manner whatsoever. (ii) he shall not leave the country under any circumstance without permission of the learned trial Court. (iii) he shall appear before the learned trial Court as and when directed. (iv) he shall provide his address where he would be residing after release and shall not change the same without informing the concerned IO/SHO. (v) the petitioner shall upon his release give his mobile phone number to concerned IO/SHO and shall keep his mobile phone switch on all times. 7. In the event of there being any FIR/complaint lodged against the petitioner, it shall be open to the respondent to seek redressal by filing an application seeking cancellation of bail. 8. It is made clear that any observation made herein above is only for the purpose of deciding the present petition and the same shall have no bearing on the merits of the case. 11.09.2025
