1. The petitioner has filed the present writ petition claiming the following reliefs:-
“(10.1) The Hon'ble Court may kindly be pleased to set-aside/quash the impugned order dated 30.06.2025 issued by the Deputy Secretary, Water Resources Department, Naya Raipur, Atal Nagar (C.G) to the extent it relates to petitioners. (P/1) (10.2) The Hon'ble Court may kindly allow petitioner to make detailed representation before the respondent authority and the same to be decided by the respondent authority. (10.3) Grant any other writ(s), order(s), relief(s) in favour of the petitioner, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case, including awarding of the costs to the petitioner.”

Learned counsel for the petitioner would restrict his submission that the petitioner is an Executive Engineer and posted at the office of Superintending Engineer, Kelo Project, Kharsia, District Raigarh, but vide order dated 30.06.2025, the respondent No.5, who is junior to the petitioner has been made in-charge of Superintending Engineer, Kelo Project, Kharsia, which is the violation of the circular issued by the State Government dated 04.08.2011. Since, the respondent No. 5 has already joined at his transferred place of posting, the petitioner may be permitted to make his representation, and then the authority concerned may be
directed to decide the representation of the petitioner, in accordance with law.

3. On the other hand, learned counsel appearing for the State would submit that they have no objection, if the petitioner moves any representation to the authority concerned and then the authority concerned will decide the representation in accordance with the law.

Considering the limited submissions made by learned counsel for the petitioner, the petitioner is directed to make his representation within two weeks from today, and if such representation is being made along with a copy of this order by the petitioner, then the respondent No. 1 shall decide the representation of the petitioner, in accordance with law, on its own merits, as per the prevailing rules and circulars within a period of 90 days from the date of receipt of the representation.
