(At Present Confined In Central Jail Jaipur) ----Petitioner Versus The State Of Rajasthan, Through P.P. ----Respondent For Petitioner(s) : Mr. Pushpendra Kumar Pandey Mr. Narendra Singh Gurjar For Respondent(s) : Mr. Rajendra Singh Shekhawat, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 20/01/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 40/2024 registered at Police Station SOG, District ATS and SOG, Jaipur for the offence under Sections 420, 467, 468, 471 and 120-B of IPC and Section 66-D of IT Act.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. The offences alleged to have been committed by the petitioner are exclusively triable by Magistrate, the accused-petitioner is in custody since 04.10.2024 and charge-sheet has already been submitted before the concerned court, the trial of the case may take considerable time. There is no criminal antecedents against the petitioner, therefore, the petitioner may be enlarged on bail.
[2025:RJ-JP:2772] (2 of 2) [CRLMB-15713/2024] Per contra, learned Public Prosecutor opposes the grant of bail application and submits that petitioner has submitted a forge certificate in the examination conducted by Education Directorate, Bikaner for the post of primary Teacher, therefore, considering the allegations levelled against the petitioner his bail application deserves to be dismissed. Heard and perused the material available on record. Considering the arguments advanced by the counsel for the parties and the fact that accused-petitioner is in custody since 04.10.2024 and charge-sheet has already been submitted before the concerned court, the trial of the case may take considerable time. Looking to the fact of the case that the offences alleged against the petitioner are exclusively triable by Magistrate, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Manoj Kumar S/o Shishram, in connection with FIR No. 40/2024 registered at Police Station SOG, District ATS and SOG, Jaipur shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
