[2025:RJ-JP:2771] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 15434/2024 Rizwan @ Lalli S/o Shri Mohammad Kamil, Aged About 34 Years, R/o House No. 4546, Shatar Walon Ki Gali, Sanjay Bazaar, Police Station Manak Chowk, Jaipur. (At Present At Confined In Central Jail, Jaipur). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Shantanu Bansal For Respondent(s) : Mr. Rajendra Singh Shekhawat, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 20/01/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 453/2024 registered at Police Station Ramganj, District Jaipur City (North) for the offence under Section 4/25 of Arms Act. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. The offences alleged to have been committed by the petitioner are exclusively triable by Magistrate, the accused-petitioner is in custody since 07.10.2024 and charge-sheet has already been submitted before the concerned court, the trial of the case may take considerable time, therefore, the petitioner may be enlarged on bail. Per contra, learned Public Prosecutor opposes the grant of bail application and submits that petitioner is a habitual offender [2025:RJ-JP:2771] (2 of 2) [CRLMB-15434/2024] and against him 21 cases have been registered under various offences. Heard and perused the material available on record. Considering the arguments advanced by the counsel for the parties and looking to the fact of the case that the offences alleged against the petitioner are exclusively triable by Magistrate, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Rizwan @ Lalli S/o Shri Mohammad Kamil, in connection with FIR No. 453/2024 registered at Police Station Ramganj, District Jaipur City (North) shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge. The accused- petitioner is also directed to mark his presence on 25th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station shall send the presence report of the accused petitioner to the trial court every month. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned Magistrate.
