ORDER: This Criminal Petition is filed under Section 528 of BNSS 2023 to quash the proceedings against the petitioner/accused in C.C.No.1164 of 2021 on the file of the learned I Special Magistrate, Visakhapatnam.
2. Heard Sri Venkateswarlu Sanisetty, learned counsel for the petitioner.
3. Learned Additional Public Prosecutor representing the State takes notice for respondent No.1.

Learned counsel for the petitioner would submit that the only request of the petitioner in this case is to dispense with the presence of the petitioner before the learned I Special Magistrate, Visakhapatnam in the proceedings vide C.C.No.1164 of 2021.

He would further submit that the husband of the petitioner is suffering from serious ill-health, and therefore, she is failed to attend before the learned Magistrate for every adjournment. whereas the learned Magistrate insisting the presence of the petitioner for every adjournment, though she is represented by
3 the counsel, and her presence is not necessary for every adjournment. Her counsel will attend for every adjournment and the petitioner will attend as and when her presence is necessary, as directed by the learned Magistrate. Considering the facts and circumstances submitted by the
learned counsel for the petitioner stated above, the criminal petition can be disposed of at the stage of admission with direction, without going into the merits of the case, and dispensed with the presence of the petitioner before the learned I Special Magistrate, Visakhapatnam, in the proceedings vide C.C.No.1164 of 2021, except her presence is necessary and ordered by the learned Magistrate for her presence. However, the petitioner’s ♦ f counsel shall appear in other days of hearing of the case before the learned Magistrate.

7. Accordingly, the Criminal Petition is disposed of at the stage of admission with the above direction. As a sequel thereto, the interlocutory applications, if any pending in this Criminal Petition shall stand closed.
