The present CRMP has been filed by the petitioners with the following prayer :- “It is, therefore, most respectfully prayed that this Hon'ble Court may kindly be pleased to allow the petition and quash the first information report registered at police station Farasgaon, District Kondagaon Chhattisgarh for offence punishable under Section 498-A, 34 of the Indian Penal Code as well as criminal investigation of registered crim No. 96/2022, in the interest of justice.” 2. At the very outset, learned counsel for the petitioners would submit that the charges have been framed against the petitioners by the trial Court concerned and the case is fixed for recording of evidence of the prosecution witnesses, therefore, we are not inclined to entertain the present petition at this stage, to which learned counsel for the 3 petitioners seeks permission of this Court to withdraw this petition with liberty to file afresh with proper prayer and documents. 3. Learned State counsel has no objection. 4. In view of the submissions made by learned counsel for the petitioners, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for. 5. Certified copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioners/ State after obtaining the photocopy of the same.
