04/ Dated 28.04.2025
Heard Mr. K. S. Nanda, learned counsel for the appellant and Mr. A. K. Tiwari, learned A.P.P on behalf of the State.
This appeal is directed against the order dated 22.01.2025 passed by the learned Sessions Judge, Gumla in B.P. No.24/2025, arising out of Gurdari P.S. Case No.01/2022, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that some extremists had set fire on the camp which resulted in a huge loss suffered by the company. So far as the appellant is concerned, he has been implicated on suspicion on account of confession and one of the similarly situated co-accused has been granted bail by this Court in Cr. Appeal (D.B.) No.1088 of 2022. The appellant is in custody since 08.07.2024. Regard being had to the above, we, while setting aside the order dated 22.01.2025 passed by the learned Sessions Judge, Gumla in B.P. No.24/2025, arising out of Gurdari P.S. Case No.01/2022, direct that the appellant, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri P. Kumar, learned Judicial Magistrate, 1st class, Gumla, in connection with Gurdari P.S. Case No.01/2022. This appeal is allowed.
