This is the Fifth Bail Application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 06/2023 registered at Police Station – Inquiry Agency – N.C.B. (Narcotic Control Bureau), Indore, District Indore (M.P), for the offence punishable under Sections 8/20, 25, 27A read with Section 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. The first and second bail application of the present applicant being
2 MCRC No. 6331 of 2023 and 4278 of 2024 were rejected by this Court vide order dated 29.09.2023 and 19.06.2024 on the ground that the contraband article which has been seized from the possession of the present applicant was much above the commercial quantity, and the third and fourth bail application of the present applicant were rejected on the technical grounds being MCRC No. 6668 of 2024 and 7661 of 2024 vide orders dated 26.09.2024 and 21.11.2024. 3. Case of the prosecution, in brief, is that the police of Police Station Inquiry Agency – N.C.B. (Narcotic Control Bureau), Indore, District Indore (M.P), seized 118.110 Kgs of Cannabis (Ganja) from the joint possession of the present applicant along with other co- accused person, namely, Deepak Kumar Markam, thereafter, the police has registered offence punishable under Sections 8/20, 25, 27A read with Section 29 of the NDPS Act against applicants. 4. Learned counsel for the applicant submits that this is the fifth bail application of the present applicant and the charge-sheet has already been filed and case is pending before the learned Special Judge (NDPS) Bilaspur, District Bilaspur, in Special Case (NDPS) No. 146/2023 and there is delay in conclusion of the trial.
He further submits that till date out of 13 prosecution witnesses only 06 prosecution witnesses have been examined and the applicant is in jail since 12.08.2023, conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the applicant. 5. On the other hand, learned State counsel opposes the bail application of the present applicant

6. I have heard learned counsel appearing for the parties and perused the case diary. 7. From perusal of the case diary, it transpires that the contraband article which has been seized from the possession of the present applicant is much above the commercial quantity and it cannot be a case of false implication, the trial is in progress. 8. Accordingly, the Fifth bail application of the applicant – Praveen Vastrakar, involved in Crime No. 06/2023 registered at Police Station – Inquiry Agency – N.C.B. (Narcotic Control Bureau), Indore, District Indore (M.P), for the offence punishable under Sections 8/20, 25, 27A read with Section 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected. 9. OfÏce is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. - Sd/-
