This is a writ petition under Article 226 of the Constitution of India wherein the writ petitioner has prayed for the following substantial reliefs: "[A] issue a writ of certiorari quashing the impugned auction notice which is published on 28.02.2025 and fixed the date of auction on 25.03.2025 issued by the respondent bank. (Annexure no.4 of the writ petition). [B] issue a writ, order or direction in the nature of mandamus commanding and directing the respondents not to take any coercive measures against the petitioner during the pendency of the present writ petition." 3. In the present case the petitioner is a co-sharer of the property that has to be for auction. 4. The petitioner submits that a securitization application filed by one Suneet Awasthi bearing S.A. No.183 of 2024 (Shri Suneet Awasthi and others Vs. Authorised Officer, Punjab and Sind Bank) is pending before the Debts Recovery Tribunal, Allahabad. The petitioner has filed an impleadment application in the aforesaid securitization application that is also pending till date. 5. In light of the same, this writ petition is disposed of with a direction given upon the Debts Recovery Tribunal to expeditiously hear out the impleadment application of the petitioner in accordance with law.
