THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioners seek for the following reliefs:- “ WHEREFORE, the petitioners respectfully pray that this Hon’ble court may be pleased to call for the records, hear the parties and quash the proceedings in Crl.Misc.No. 301 of 2024 pending before the Prl.Civil Judge & JMFC, Hosakote vide Annexure-E filed under Section 12 of Protection of Women from Domestic Violence Act, 2005, to meet the ends of justice.” 2. Heard learned counsel for the petitioners as well as learned counsel for respondent and perused the material on record. 3. A perusal of the material on record will indicate that the 1st petitioner is the husband of the respondent, while petitioners 2 and 3 are his parents and petitioner No.4 is the sister of the 1st - 3 - NC: 2025:KHC:5231 CRL.P No. 11295 of 2024 petitioner. The respondent instituted the proceedings under the Protection of Women from Domestic Violence Act,2005 against the petitioners by making the allegations vide Annexure-D dated 19.09.2024. On the basis of which, Crl.Misc.No.301/2024 is filed against the petitioners. 4. Though the petitioners herein seek to urge various contentions in support of their defence, a careful perusal of the various averments made in the aforesaid petition filed by the respondent would indicate that there are several contentious issues and disputed questions of law between the parties, which would necessarily have to be decided by the trial court only after full- fledged trial. It is also relevant to state that the petitioners have already entered appearance and have filed the statement of objections to the main petition. Under these circumstances, I deem it just and appropriate to dispose of this petition reserving liberty in favour of the petitioners to urge all their contentions before the learned Magistrate, who shall provide sufficient and reasonable opportunity and dispose of the aforesaid petition on merits and in accordance with law. - 4 - NC: 2025:KHC:5231 CRL.P No. 11295 of 2024 5.
