In this petition filed under Section 528 of BNSS, 2023, the petitioner seek a direction for to expedite and conclude the trial in Criminal Case No. 1341/2023 pending before the learned Judicial Magistrate First Class (JMFC), Katghora, District-Korba (C.G.). 2. Facts of the present case are that the petitioner and respondent No. 1 were married on 10.12.2017, at Muzaffarpur, Bihar, as per Hindu rites and rituals. The other respondents are respondent No. 1's immediate family members. Before the marriage, the Respondents demanded dowry, which the Petitioner's family fulfilled by providing over 25,00,000 in cash ₹ and bank transfers, a Honda City car, and bearing the entire marriage expenditure in a 5-star hotel. The marriage was allegedly a non-starter due to the Respondents' greed and avarice. The Petitioner and her family were subjected to continuous harassment, coercion, and exploitation for more money, jewelry, and valuables. The Petitioner was allegedly subjected to mental cruelty, inhuman treatment, and taunts, particularly after giving birth to a girl child in 2019. On 16.08.2021, the Petitioner and her 2-year-old daughter were thrown out of the matrimonial house, leaving them without basic amenities. Thereafter, the Petitioner filed an FIR (No. 215/2021) at PS-Darri, Korba (C.G.), against the Respondents, alleging ongoing harassment and dowry demands. 3. Learned counsel for the Petitioner submits that the FIR was filed in 2021, and the charge-sheet was filed on 20.06.2023. Despite this, the trial proceedings have been delayed due to repeated 3 adjournments sought by the Respondents on grounds of non- appearance. As a result, the prosecution evidence has not commenced even after more than two years, and the proceedings are progressing at a slow pace over the past 2 years. In light of these circumstances, the counsel humbly prays that this Court may direct the Trial Court to expedite the trial proceedings and conclude the same as expeditiously as possible. 4. I have heard learned Counsel appearing for the Petitioner and perused the documents annexed with the petition including the order sheets of the Trial Court. 5. Upon perusal of the records, it is evident that the charge-sheet was filed on 20.06.2023, and the case was first listed for charge framing on 09.10.2023. After numerous adjournments, the charges were finally framed on 28.03.2025 and the case was fixed for prosecution witnesses. There appears to be an inordinate delay in framing the charges and in view of the limited prayer made in this petition, without commenting on the merits of the case, this Court directs the concern Court to expedite the trial proceedings as expeditiously as possible. 6.
