Order 20/01/2025
1. The instant application under Section 483(3) BNSS has been submitted for cancellation of bail granted to respondent-Manish Kumar by this Court vide order dated 04.12.2024.
2. Counsel submits that first bail application of the accused respondent -Manish Kumar was rejected by this Court vide order dated 07.08.2024, granting him liberty to renew his prayer for bail after recording of the statements of witnesses, Yogesh and Harish. Counsel submits that when the statement of witness- Yogesh was recorded as PW19, he has specifically levelled allegations of committing murder against the respondent-Manish Kumar. Counsel submits that this Court granted bail to the accused Manish Kumar on the ground that his case is at par with the case of Rambeer. Counsel submits that the case of the accused Manish Kumar was distinguishable, hence under these circumstances, the

order of indulgence of bail granted to the respondent-Manish Kumar is liable to be rejected.
3. Heard and considered the submissions made at bar and perused the material available on record.
4. This fact is not in dispute that the first bail application of the respondent was rejected by this Court on 07.08.2024 granting liberty to renew his prayer for bail after recording the statements of the witnesses Yogesh and Harish. This fact is not in dispute that Harish has turned hostile and he has not supported the case of the prosecution. This Court after considering the statement of PW-19- Yogesh, granted indulgence of bail to him on the ground of parity as the similar allegations were levelled against the co-accused Rambeer to whom indulgence of bail was already granted by this Court.
5. Counsel for the petitioner has failed to satisfy this Court that whether the allegations of committing murder was only against the respondent-Manish Kumar, rather the allegations of commission of offence was against three accused persons Ramveer, Manish Kumar and Ajit.
6. Looking to the facts that Rambeer was granted indulgence of bail on the ground of parity and the same indulgence of bail was granted to the respondent- Manish Kumar, hence under these circumstances, no case is made to cancel the bail granted to the respondent-Manish Kumar.
7. Accordingly, the application for cancellation of bail has been rejected.
