Heard the parties.
Petitioner has been made an accused in connection with S.T. Case No. 86/2024, arising out of Gumla P.S. Case No. 412/2023, corresponding to G.R. Case No.134 of 2024, for the offence under sections 376, 302, 201/ 34 of IPC, pending in the court of learned Additional Sessions Judge - I - cum – Spl. Judge, Gumla. Bail Application of the petitioner was earlier rejected by this Court vide B.A. No.2901 of 2025 by order dated 11.04.2025. On 30.11.2023, daughter of the informant was raped and beheaded. During the course of investigation witnesses have stated about the complicity of the petitioner. While rejecting the bail application of the petitioner, it was observed that the trial was under progress out of 9 witnesses, 7 witnesses have already been examined.
Learned counsel for the petitioner submitted that now 8 witnesses have been examined and only doctor is remained to be examined. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail stands rejected. The learned trial court shall take all possible steps to procure attendance of the doctor.
