CMP(T) No.705 of 2021 Instant application has been filed for placing on record additional documents i.e. the Certificate issued by President of Sanjhi Van Pariyojna Sharoun Chhataryana, Tehsil Arki, District Solan [Annexure P-4] and the Mandays Chart of another incumbent Babu Ram as Annexure P-5 and Annexure P-6. 2. Upon issuance of notice on this application on 02.11.2022 respondents have filed a Reply-Affidavit dated 18.10.2022 wherein, the State Authorities have taken a stand that the petitioner was engaged initially in 1988 and he worked as such till the year 2006 with 240 days [except for the non-completion of 240 days during the years 1998, 1999 and 2002]. Reply-Affidavit states that Competent Authority of H.P. Forest Department, has not issued any Certificate [Annexure P-4] to the petitioner and even Pradhan of Forest Development Society has not issued Certificate as in Annexure A-4 to the petitioner. So far as mandays of one Shri Babu Ram, the stand of Respondents is that his case is altogether different to whom benefit of continuity has been given in terms of Award dated 19.07.2010 [Annexure RA-II], and the documents pertaining to Babu Ram i.e. Annexure P-5 and Annexure P-6 being part of official records can be taken on record. 3. Be that as it may, in above backdrop, the instant application is allowed and Annexure P-5 and Annexure P-6 are taken on record, subject to just exceptions and its applicability. Since veracity of Certificate i.e. Annexure P-4 is disputed, the same is not permitted to be read as part of the instant proceedings. In the aforesaid terms, the instant application is disposed of.
