Learned counsel for the appellant has pointed out that in the present case, the respondent-plaintiff had filed a suit in the year 1991 for declaration to the effect that he is entitled to the benefits of military service which he had rendered during the proclamation of emergency and the said suit was decreed and the appeal filed by the appellant was dismissed. It is submitted that the institute of the Hotel Management, Panipat, which was earlier part of the Haryana Tourism Corporation Limited, and is now a separate entity, has decided to implement the said judgments of the trial Court and the 1st Appellate Court and has further submitted that thus in view of the said subsequent stand, the present appeal be disposed of as having been rendered infrutuous. 2.
