The present application u/s 528B.N.S.S has been filed with a prayer to quash the entire proceedings of Criminal Case No. 2292 of 2021 (State vs. Kanhaiya Yadav and others) arising out of Case Crime No. 61 of 2021, under Sections 147, 148, 323 of IPC, Police Station Sahatwar, District - Ballia as well as cognizance/summoning order dated 06.08.2021 pending in the court of Judicial Magistrate-II, Ballia. After some arguments, learned counsel for the applicant does not want to press the application and wants liberty to file a appropriate application/proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
