THE HON’BLE SRI JUSTICE V.SRINIVAS APPEAL SUIT No.43 of 2012 JUDGMENT: On perusal of the docket proceedings dated 07.08.2025, it is observed that:- “On perusal of the record, the appellant No.2 has withdrawn the present appeal, and the same was endorsed on the E.B. vide order dated 12.02.2025. The appeal remains has to be decided between appellant No.1 and the respondents. On 07.05.2025, there was no representation for the appellant No.1 and the learned counsel for the respondents was in attendance. Hence, this Court directed the Registry to post the matter under the caption „for dismissal‟ on 27.06.2025. Thereafter, the matter was not listed on that day and subsequently directed to be listed today i.e., 07.08.2025 under the same caption. Today also, there is no representation on behalf of the appellant No.1. Learned counsel for the respondents is present. List the matter on14.08.2025 under the same caption.” 2. Even today also none appeared for the appellant. Learned counsel for the respondents is in attendance. 3. In spite of the matter being listed today under the caption ‘for dismissal’, none came forward to address the arguments. 4. Thereby, the Appeal Suit is dismissed for default.
