1Neutral Citation No. - 2025:AHC:33296 Court No. - 10 Case :- WRIT - A No. - 10741 of 2019 Petitioner :- Sharda Prasad Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Jata Shankar,Sanjai Kumar Pandey Counsel for Respondent :- A.K.S.Parihar,C.S.C.,Satyaveer Singh Hon'ble Saurabh Shyam Shamshery,J.
1. Heard Sri Sanjai Kumar Pandey, learned counsel for the petitioner and Sri A.K.S.Parihar, for the respondents.
2. In the present case, during pendency of earlier writ petition, a revised result was published so far as OBC candidates was concerned, wherein the petitioner's name was shown at Serial No.33. However, when subsequently an amended result was published later on, petitioner was not included in the list of 53 OBC candidates.
3. It is not under dispute that petitioner has lesser marks than the last cut off marks i.e.382.60, whereas the petitioner has obtained 379.28 marks in OBC (OH) category. Two other persons from OBC and (OH) category namely Hari Nath Yadav and Ajay Kumar obtained 395.38 and 382.75 marks respectively and they were selected and admittedly petitioner was below to them.
4. Learned counsel for the petitioner has tried to make out a case that one Hari Nath Yadav initially joined in the General Category and later on in the revised list, was shown in the OBC
(OH) Category and due to that petitioner was not included in the list of selected candidates.
5. Hari Nath Yadav is not a party before this Court and petitioner wants to pass an adverse
order against him.
6. It is well settled that in such cases, writ petition is not maintainable.
7. Petitioner has not come up with a case that any person junior to him was appointed.
8. Learned counsel for the petitioner has not been able to show that reservation was for more than two seats i.e. in the category OBC, (OH), therefore, all the arguments advanced has no legal basis.
9. Writ Petition is accordingly dismissed.
