Case No.53 of 2025 dated 21.02.2025 under Sections 61(2)/316(2)/318(4)/336(2)/336(3) of the Bharatiya Nyaya Sanhita, 2023. And
In the matter of: Sekh Saimur Aahammad @ Sekh Saimur Ahamed ….Petitioner. Mr. Sachit Talukdar Mr. Subhendu Bandyopadhyay Mr. Arka Mondal
…for the petitioner Ms. Faria Hossain Md. Yaser A. Ismail
….for the State
Memo of Evidence filed on behalf of the State is taken on record.
Heard the learned counsels for the parties.
Perused the case diary.
Considering the serious nature of allegations and the incriminating materials available in the case diary including the statement of a witness contained at page 48 of the case diary, which purportedly revealed that although the petitioner as the owner of a POS was issuing SIM cards to customers, he was taking additional photos, copies of documents and signatures/thump impression to have more SIM cards issued in the same name to be used by unknown others, I do not consider this to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail is rejected.
