The petitioner is aggrieved by the impugned proceedings dated 15.09.2025, whereby the 2nd respondent called upon the petitioner to have the premises vacated as the petitioner has leased the premises belonging to him to a business entity who are operating logistic services (Swiggy, insta mart). It is stated in the said notice that the commercial activity could not have been permitted in a building for which the permission was sought for residential use. 2. Learned counsel for the petitioner submits that the petitioner had executed a lease deed on 05.09.2024 for a period of five years. However, submits that the impugned notice would grant a weeks’ time for vacating the same. It is submitted that the petitioner would have to request the tenant to vacate the premises after identifying an alternate suitable property for running their business. As such, requested this Court to fix a reasonable time for eviction. 3. Learned standing counsel appearing for the 2nd respondent submits that when the permission is obtained for residential building from the 2nd respondent, the petitioner could not have put it to commercial use. 4. Be that as it may, considering the submissions, time is granted for eviction of the premises is only seven years and also considering the request, the impugned proceedings shall stands suspended for a period of four months from today making it clear to the petitioner to get the property vacated by his tenants within the period of four months. 5. Accordingly, the writ petition is disposed off. No costs.
