THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.4 in Spl.C.No.74/2022 pending before the Court of XXXIII Additional City Civil and Sessions Judge and Special Judge for NDPS cases, Bengaluru arising out of NCB Cr.No.48/1/10/2021/BZU registered by Narcotic Control Bureau, Bangalore Zonal Unit for offences punishable under Sections 8(c) read with Section 20(b)(ii)(c), 23(c), 25, 27, 28 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'NDPS Act') is before this Court under Section 439 of Cr.PC seeking regular bail. 2. Learned Counsel for the petitioner submits that petitioner is in custody from 24.09.2021 onwards. He had earlier approached this court in Crl.P.No.7908/2023 which - 3 - NC: 2025:KHC:12518 CRL.P No. 10855 of 2024 was dismissed as withdrawn by order dated 17th January, 2024 with liberty to the petitioner to renew his bail application before the Trial Court, if the trial is not concluded within a period of six months from the date of order passed in the said petition. 3. Leaned Counsel for the petitioner has submitted that till date two witnesses have been examined as P.W-1 and P.W-2 out of seven chargesheet witnesses cited in the present case. In view of the delay in trial, he prays to allow this petition. 4. Per contra, learned Counsel appearing for respondent submits that petitioner is a person with criminal antecedents and he is involved in another criminal case and he is now being tried in Spl.C.C.No.4041/2021 before the very same Court with similar allegations. In the said case his bail application has been rejected by the Court and the coordinate Bench of this Court had directed the Trial Court to dispose off the main case expeditiously. He submits that similar direction may be given even in the - 4 - NC: 2025:KHC:12518 CRL.P No. 10855 of 2024 present case and since material chargesheet witnesses are already examined, if further period of four months is granted efforts shall be made to examine the remaining chargesheet witnesses before the Trial Court within the said period. 5. Submissions made on both sides placed on record. 6. Petition disposed off with request to the Trial Court to expedite the trial in the case and dispose off the matter on merits as expeditiously as possible but not later than a period of four months from the next date of hearing before the Trial Court.
