JUSTICE MOKSHA KHAJURIA KAZMI, JUDGE ORDER 23.05.2025 1. Through the medium of the instant petition, the petitioners have sought the following reliefs: i. Mandamus commanding the respondents to forthwith refund an amount of ₹1,10,52,150/- deposited by petitioner No. 1 to obtain grant, execute and register mining lease for Block No. Doda-III with description Left Bank of River Chenab located at Tehsil Mohalla, District Doda along with @12% simple interest from the date the amount was deposited till returning of the same. ii. Mandamus commanding the respondent No. 4 to forthwith refund an amount of ₹2,21,043/- @2% Income Tax deposited by petitioner No. 1 in favour of Income Tax Commissioner, Jammu vide demand draft No. 345138. iii. Mandamus commanding the respondents to forthwith refund an amount of ₹1,52,95,500/- duly deposited by petitioner No. 2 to obtain grant, execute and register mining lease for Block No. 28/J with description Sardan Nallah at Upstream Sr. No. 67 Railway Bridge Pargolta area, District Jammu along with @12% simple interest from the date it was deposited till returning of the same. iv. Mandamus commanding the respondent No. 4 to forthwith refund an amount of ₹2,21,043/- @2% Income Tax deposited by petitioner No. 2 in favour of Income Tax Commissioner, Jammu vide demand draft No. 399506. 2. Learned counsel for the petitioners states that he would feel satisfied if the instant petition is disposed of with the direction to the respondents to consider the claim of the petitioners as made in the prayer of the writ petition within a reasonable period of time. 3. On the other hand, Mr. Dewakar Sharma, learned Dy.AG states that he is not averse to the proposition made by the learned counsel for the petitioners. 4. Be that as it may, the instant petition is disposed of, at the threshold, without expressing any opinion on the merits of the petition, thereby, directing respondents to consider the writ petition of the petitioners as representation and pass appropriate orders strictly in accordance with law within a period of two months from the date of passing of this order.
