The petitioner was a State employee at the Police department since July 20, 1986 and retired on February 28, 2023. The petitioner has not yet received pensionery benefits. W.P.A. 705 of 2025, A. Roy,J. 2 2. Mr. Subhankar Dutta, learned State advocate appearing in the matter has placed a bunch of documents which shows, inter alia, that the necessary Pension Payment Order has already been issued on January 2, 2024 for pensionery benefits with effect from March 1, 2023. The said bunch of documents is taken on record. 3. Mr. Sourab Kar, learned advocate appears for respondent no. 2, on instruction from his client submit that the petitioner is a State employee. The PPO had already been issued and the petitioner shall be entitled to receive pensionery benefits. 4. In view of the above, following directions are made: (a) The respondent no. 3 shall produce all the revlevent documents including the said Pension Payment Order before the respondent no. 2 positively within two weeks from the date of communication of this order; (b) The respondent no. 2 upon verification of record then shall calculate and quantify the arrear to be paid to the petitioner strictly in accordance with law to which petitioner is eligible with effect from March 1, 2023 along with interest @ 6% per annum until the actual amount is tendered to the petitioner and then shall transmit and forward the relevant records and communications to the jurisdictional Treasury Officer; (c) This exercise shall be carried out and completed by the respondent no. 2 positively within four weeks from the date of receiving records from the respondent no. 3; W.P.A. 705 of 2025, A. Roy,J. 3 (d) The jurisdictional Treasury Officer then shall release all the pensionery benefit including arrear with the accrued interest, as directed herein, in favour of the petitioner by crediting the bank account of the petitioner through electronic mode of transfer but positively within six weeks from the date of receiving the communication from the office of the respondent no. 2; (e) The jurisdictional Treasury Officer then shall go on and continue to pay the petitioner’s current pensionery benefits in accordance with law. 5. Since affidavits are not called for, allegations made in this writ petition are deemed not to have been admitted by the respondents. 6. With the above observations and directions this writ petition being WPA 705 of 2025 stands disposed of, without any order as to costs. 7.
