[2025:RJ-JP:6004] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 15327/2024 Mukesh S/o Kailash, R/o Bhada Ka Badiya, Post Chatarpura, Police Station Badnor, District Beawar, At Present Resident Of Vijay Nagar Road, Infront Of Sub Jail, Police Station Saket Nagar, Beawar (Raj.) (At Present In Sub Jail Beawar, Distt. Beawar). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Shyam Bihari Gautam For Respondent(s) : Mr. Omkar Singh Rajpurohit, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 11/02/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.379/2024 registered at Police Station Masuda, District Beawar for the offence(s) under Section 108 of BNS. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. There is no substantial evidence against the accused-petitioner that the accused-petitioner instigated or abetted the deceased soon before his death resulting into suicidal act. The accused-petitioner is in custody since long and trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. [2025:RJ-JP:6004] (2 of 2) [CRLMB-15327/2024] 3. Learned Public Prosecutor has vehemently opposed the bail application. 4. Heard and perused the material available on record. 5. Considering the fact that the charge-sheet against the accused-petitioner has already been produced. There is no suicidal note recovered by the investigating agency. In the transcription audio clip, there is nothing against the accused-petitioner which indicate that the accused-petitioner has instigated the deceased. The transcription shows that there was some transaction between the accused-petitioner and the deceased, and the accused- petitioner purchased the property from the deceased and was forcing him to handover the possession. Therefore, considering the above facts and without further expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Mukesh S/o Kailash in connection with FIR No.379/2024 registered at Police Station Masuda, District Beawar, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
