The applicant has preferred this application under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 101/2025, registered at Police Station – Somani, District – Rajnandgaon (C.G.) for the alleged commission of offence punishable under Section 420 of IPC, 1860.

According to the prosecution story, it is alleged that the complainant Tarkeshwar Nath has filed a complaint before the Police Station Somani, Rajnandgaon, District Rajnandgaon (C.G.), alleging therein that the applicant had committed fraud of Rs. 5,71,100/-, thereby VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.07.29 10:43:26 +0530
2 the applicant being showing himself to be the General Power of Attorney holder of M/s Jagdamba Infotech Chandrapur had executed an agreement on 11.12.2023 in his favour and obtained a loan, of which installment for the period from 20.05.2023 to 01.05.2025 totaling to Rs. 5,71,100/- received towards the execution of the sale deed in favour of complainant, the applicant by way of putting false signature in the Office of Registrar, Rajnandgaon and executed the sale deed for the Plot No. 154-155. Based on the written complaint / report, the Police Station Somni has registered the offence punishable Under Section 420 of the Indian Penal Code, 1860 under Crime No. 101/2025.

Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He further submits that applicant has no any role in the instant crime, as has been implicated on the basis of false and fabricated evidences put forth by the prosecution. He also submits that there is no documentary or oral evidence to connect the applicant in the alleged crime. Therefore, he prays for grant of anticipatory bail to the present applicant. 4. On the other hand, learned State counsel opposes the submission made by the learned counsel for the applicant. The applicant had committed fraud of Rs. 5,71,100/-, thereby the applicant being showing himself to be the General Power of Attorney holder of M/s Jagdamba Infotech Chandrapur had executed an agreement on 11.12.2023 in his favour and obtained a loan, of which installment for the period from 20.05.2023 to 01.05.2025 totaling to Rs. 5,71,100/- received towards the execution of the sale deed in favour of complainant, the applicant by way of putting false signature in the Office of Registrar, Rajnandgaon and executed the sale deed for the
3 Plot No. 154-155, and applicant has two criminal antecdents of same offence. Therefore, he is not entitled for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the nature and gravity of the offence and material on record in the case diary and also considering the fact that the applicant had committed fraud of Rs. 5,71,100/-, thereby the applicant being showing himself to be the General Power of Attorney holder of M/s Jagdamba Infotech Chandrapur had executed an agreement on 11.12.2023 in his favour and obtained a loan, of which installment for the period from 20.05.2023 to 01.05.2025 totaling to Rs. 5,71,100/- received towards the execution of the sale deed in favour of complainant, the applicant by way of putting false signature in the Office of Registrar, Rajnandgaon and executed the sale deed for the Plot No. 154-155, and applicant has two criminal antecedents of same offence as such, I am not inclined to grant anticipatory bail to the applicant. 7.
Accordingly, the anticipatory bail application of the applicant– P. Vijay Kumar filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No. 101/2025, registered at Police Station – Somani, District – Rajnandgaon (C.G.) for the alleged commission of offence punishable under Section 420 of IPC, 1860, is rejected.
