Rupa Yadav despite of being aware that petitioner has also filed FA(MAT) No. 33/2024 which has been filed against the order of divorce dated 21.12.2023 passed by learned Family Court and has violated the order passed by Hon’ble High Court vide order dated 25.01.2024 whereby the Court had directed that parties shall govern by the statutory provisions of Section 15 of Hindu Marriage Act. 2 After arguing for some time, learned counsel for the petitioner submits that he wants to withdraw this petition with liberty to file a fresh petition before the appropriate Bench. 3 Learned State counsel has no objection to this proposition put forth by the counsel for the applicant. 4 Prayer is allowed. 5 Accordingly, this petition is dismissed as withdrawn with the aforesaid liberty.
