OIC Ltd. vs. Neha Choudhary and others FAO No. 201 of 2025 22.11.2025 Present: Mr. Ishan Sharma, Advocate, for the appellant. Mr. Vijender Katoch, Advocate, for respondent No. 1. Mr. Maan Singh, Advocate, for respondent No. 4. Mr. Sarthak, Advocate, vice Ms. Dhanwanti, Advocate (Court Guardian), for respondent Nos. 2 and 3. CMP No. 24580 of 2025 Heard learned counsel for the parties and perused the pleadings. No reply is intended to be filed on behalf of non- applicants. Respondent No. 1 was served for 08.09.2025 and since none had put in appearance on her behalf, despite being duly served, hence respondent No. 1 had been ordered to be proceeded against ex parte. It is a well settled position of law that ex-parte means ex-parte for the day and not ex-parte for the entire proceedings. In this respect, reference can be made to the authoritative pronouncement of the Apex Court in AIR 1955 SCC 425, title Sangram Singh vs. Election Commission of India. Other than the aforesaid, for the sufficient cause shown for non-appearance of respondent No. 1 on 08.09.2025, the present application is allowed and respondent No. 1 is permitted to join the proceedings.
Power of attorney is stated to have been filed on behalf of respondent No. 1. Application stands disposed of.
(Bipin C. Negi) Judge November 22nd, 2025.
