Neutral Citation No. - 2025:AHC:49868-DB Court No. - 42 Case :- CRIMINAL MISC. WRIT PETITION No. - 6396 of 2025 Petitioner :- Monu And 2 Others Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Sampoorna Nand Counsel for Respondent :- G.A. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J. 1. Heard learned counsel for the petitioners and learned State Law Officer for the State respondents. 2. Present writ petition has been preferred for quashing the FIR dated 10.09.2024 registered as Case Crime No.0517 of 2024 under Sections 87, 137(2) BNS 2023, P.S. Ramgarh Taal, District Gorakhpur and for a direction to respondents not to arrest the petitioners pursuant to aforesaid FIR. 3. On the matter being taken up today, learned State Law Officer, on the instructions, submits that in the aforesaid case crime, against petitioner no.1 chargesheet has already been forwarded to the Competent Court. So far as petitioners no.2 and 3 are concerned, during investigation they have been exonerated from all the charges, therefore, the cause for filing the writ petition no more survives. 5. Considering the categorical instructions of learned A.G.A., we are not inclined to proceed further in the matter. Needless to say, in case the petitioner nos.1 is aggrieved with the submission of chargesheet, it is always open to him to agitate before the appropriate forum in accordance with law. 6. Accordingly, the writ petition is disposed of. (Prashant Kumar,J.) (Mahesh Chandra Tripathi,J.) Order Date :- 7.4.2025 A.
