Choudhary, Advocate For the State :- Mr. Rakesh Kr. Sinha, Advocate ---- 02/13.10.2025 Heard learned counsel appearing for the petitioners as well as the learned counsel appearing for the State. 2. The petitioners are apprehending their arrest in connection with Sarath P.S. Case No.73 of 2025, for the alleged offences registered under Sections 190, 191(2), 126(2), 115(2), 121(1), 125(b), 132, 117(3), 118(1), 109, 351(2) and 352 of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate 1st Class, Madhupur. 3. Learned counsel appearing for the petitioners submits that the FIR has been registered against 51 named persons and 50 to 60 unknown persons. He further submits that there are general and omnibus allegation against all the accused persons including the petitioners and the allegations are made that when the police party came in the village 2025:JHHC:31540 --2-- A.B.A. No. 5956 of 2025 for raiding the house of one of the person the villagers assembled and started pelting stones. He also submits that in identical situation co- accused persons have been granted anticipatory bail in ABA Nos.5906 of 2025 and 5931 of 2025. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of pelting stones upon the police force. 5. Considering that there are 50 named accused persons and the allegations are also there against 50 to 60 unknown persons and there are general and omnibus allegation against all the accused persons including the petitioners and in identical situation co-accused persons have been granted anticipatory bail in ABA Nos.5906 of 2025 and 5931 of 2025, I am inclined to provide anticipatory bail to the petitioners. 6. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class, Madhupur, in connection with Sarath P.S. Case No.73 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated 13.10.2025 Sangam/
