1. Heard Mr. Waquar Naiyer, learned counsel for the petitioner. Also heard Mr. Shashank Thakur, learned Deputy Advocate General, appearing for the State. 2. The present writ petition has been filed by the petitioner with the following prayers:
“i. To kindly direct the respondent authorities to expedite the process of issuance of “NO OBJECTION CERTIFICATE” and study leave in favour of petitioner for pursuing PG course. ii. Any other relief/s may be granted to the petitioner, which this Hon’ble Court may deem fit in the present fact and circumstances of the case including the cost of the petition.”
3. It has been pointed out by learned State counsel that in an identical matter, this Bench had dismissed WPC No. 522 of 2025 (Dr. Garima Ingole vs. State of Chhattisgarh & Others) vide order dated 27.01.2025 observing as follows :
“5. We have heard learned counsel for the parties and considered the submissions advanced by the respective counsel. The petitioner applied for leave on
3 23.10.2023, from 23.10.2023 to 23.10.2026 for a period of three years (Annexure P/15) for which NOC was required to be sanctioned by the respondent No. 1 in favour of the petitioner. The application of the petitioner was duly forwarded by the Director, Medical Education to the Additional Chief Secretary, Government of Chhattisgarh, Medical Education Department vide communication dated 07.11.2023 with recommendation to grant NOC. However, till date, no NOC has been granted to the petitioner and the petitioner has filed this application only on 18.01.2025 after a lapse of about one year and two months. The appellant ought to have moved the application for grant of leave well within time and then only she ought to have proceeded on leave. The petitioner had applied for leave on 23.10.2023 and no breathing time has been given to the concerned authorities as on the same date, the petitioner has proceeded on leave. The petitioner herself had not taken any steps to ascertain as to whether her leave was granted or not and whether the NOC has been granted to her. After a long period of time, the petitioner has filed this petition seeking for the aforesaid reliefs.
It is well settled principle of law that a Court ordinarily does not assist the tardy, indolent and lethargic person who himself is not vigilant towards his/her rights as such, this petition deserves to be and
4 is accordingly dismissed. However, the petitioner is at liberty to take recourse to law, before the appropriate forum, if any.” Learned State counsel further submitted that since the facts and issue involved in the present case is identical to that of WPC No. 522 of 2025, this petition may also be dismissed in the similar terms. 4. Having considered the rival submissions made by learned counsel for the parties and having gone through the materials on record, it is evident that the facts and issue involved in this petition is identical to WPC No. 522 of 2025, this Court deems it appropriate not to take a view other than what has been taken in WPC No. 522 of 2025. 5. Accordingly, the present writ petition is dismissed in terms of the
