The present application under Section 528 of Bhartiya Nagarik Suraksha Sanhita (hereinafter referred as 'BNSS') has been preferred against the order dated 16.06.2023, passed by the Additional Chief Judicial Magistrate, Auraiya, in complaint No. 1523 of 2015, under Section 420 I.P.C., P.S. Dibiyapur, district Auraiya, by means of which non-bailable warrant has been issued against the applicant. 3. After arguing at some length, learned counsel for the applicant submits that the prayer as made above is not being pressed and the applicant is willing to appear before the trial court concerned and a direction may be made to the court concerned to decide the bail application of applicant expeditiously and protection may be granted till then. 4. In view of the aforesaid, it is directed that in case, applicant appears/surrenders before the trial court concerned within a period of two weeks from today and applies for bail, his bail application shall be considered and decided expeditiously in accordance with settled law. For a period of two weeks from today or till the applicant appears/surrenders before the court concerned, whichever is earlier, no coercive action shall be taken against the applicant in the aforesaid complaint case. 5.
