JUSTICE MICHAEL ZOTHANKHUMA ORDER 08.06.2026 Heard Ms. Savita Sarna, learned counsel for the applicant. Also heard Mr. P.J. Saikia, learned Senior counsel for the NHIDCL along with Mr. Joseph L. Renthlei, learned counsel for the writ petitioners, Ms. Caroline K. Lungawipuii, learned Government Advocate for the State Government and Mr. Lianhmingthanga, learned counsel appearing on behalf of the CGC. This is an application seeking deletion/striking out from being a party to the present writ petition. The applicant’s counsel submits that the issue with regard to the payment of compensation by the State respondents to the writ petitioners, pertaining to a project funded by JICA is basically an issue to be sorted out between the State and the writ petitioners. JICA has no role to play in the issue of payment of compensation or the manner in which it is to be disbursed to the writ petitioners. Further, the issue of whether the resettlement plan to be followed by the respondents under the 2013 Act or any other model sought to be followed by NHIDCL and the Central Government would depend upon the Court, who would decide as to whether which model was more beneficial to the writ petitioners. Mr. Savita Sarna submits that JICA Guidelines for Environmental and Social Considerations provided under Clause 2.6 and Clause 4 of the Appendix-I shows Page No.# 11/12 that project must comply with the laws, ordinances and standards related to Environmental and Social Considerations, Policies and plans of the Government that has jurisdiction over the projects. She also submits that in terms of the Loan Agreement dated 31.03.2017, executed between JICA and the President of India, Schedule-II of the same provides that the allocation of the proceeds of the loan provided by JICA cannot be used for compensation purposes. As such, the issue raised in the writ petition with regard to Resettlement and Rehabilitation of the petitioners which is to be decided by a Court, as to which of the procedures provided in the JICA guidelines or the 2013 Act is more beneficial to the writ petitioners, would not have any effect on JICA. She also submits that JICA guidelines are not meant to over-ride the local laws, inasmuch as, they are funding projects all over the world. She accordingly submits that JICA may be struck off as a party from the case. Mr. Joseph L. Renthlei, learned counsel for the writ petitioners have got no objection to the deletion of JICA. Mr. P.J. Saikia, learned Senior counsel for the NHIDCL also submits that he does not have any objection to JICA being deleted as a party from the case. Ms. Caroline K. Lungawipuii, learned Government Advocate and Mr. Lianhmingthanga, learned counsel also make the same submission. In view of the above consent of the parties and keeping in view the fact that the JICA counsel had specifically stated that the loan provided by JICA to the Government of India is only for the project caused and not for compensation purposes, JICA is deleted as a party from the case.
