Heard learned Standing Counsel for the State-respondents and perused the record. 2. The instant writ petition has been filed for the following relief: "a writ, order or direction in the nature of mandamus directing the respondent no.3 to decide the demarcation application Under Section 24 of L.R. Act dated 12.12.2024 filed by petitioner, for demarcating the land of khata no. 1274, khasra no.2784, area 0.0670 hectare situated at Village Surana, Tehsil Modinagar, District Ghaziabad, within a short stipulated period as directed by this Hon'ble Court." 3. From perusal of the writ petition and annexures annexed thereto, it appears that the aforesaid application is pending since 2024 and several dates have been fixed by the Court concerned, however, till date, the same has not been decided. 4. No useful purpose would be served in keeping this petition pending. 5. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present petition stands disposed of finally with a direction to respondent No. 3 to consider and decide the aforementioned application, in accordance with law, expeditiously, preferably within a period of three months from the date of production of a certified copy of this order after ensuring service upon all the opposite parties and giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided that there is no other legal impediment.
