JUSTICE H.P.SANDESH ORAL ORDER Learned counsel for the parties have filed an application under Section 320(8) of Cr.P.C. read with Section 147 of N.I. Act and the same is also signed by the petitioner and the respondent. 2. The Trial Court sentenced the respondent- complainant to pay fine of Rs.4,30,000/- and already an amount of Rs.2,15,000/- is deposited before the Trial Court and matter is settled for total amount of Rs.3,75,000/- and balance amount of Rs.1,60,000/- is paid today by way of Demand Draft in the name of the respondent towards full and final settlement. Hence, respondent-complainant pray this Court to compound the offence by allowing the application. 3. For the reasons stated in the affidavit accompanying the application and also since the matter is - 3 - NC: 2025:KHC:11913 CRL.RP No. 1481 of 2023 settled among the parties for an amount of Rs.3,75,000/- and entire balance amount is paid to the respondent, the application is allowed. The respondent-complainant is acquitted for the offence under Section 138 of N.I. Act. 4. Learned counsel for the respondent-complainant submits that he has paid an amount of Rs.5,000/- before the Trial Court on 11.03.2025 and receipt is also produced before the Court and the same is taken on record.
