Criminal Miscellaneous Bail Application No. 15236/2024 Rachna Singh D/o Surendra Singh, Aged About 41 Years, R/o 108/33, Shivji Nagar, Habib Ganj, Bhopal (Madhyapradesh). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Deepak Chauhan For Respondent(s) For Complainant(s) : : Mr. N.S. Dhakar, PP Mr. Pradeep Mathur HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 29/01/2025
1. The instant pre-arrest bail application has been filed under Section 482 of B.N.S.S. filed on behalf of the petitioner, who is having apprehension of arrest in F.I.R. No.153/2024 registered at Police Station Nayapura, District Kota City (Rajasthan) for offences under Sections 452, 420, 120B, 386, 384 & 506 of IPC. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. Counsel submits that impugned FIR is nothing but has been lodged to make out a counter-case. Counsel submits that on earlier occasion, two separate FIRs were lodged by the petitioner in Police Station Maharanapratap Nagar & Habibganj, District Bhopal City (M.P) for the offences punishable under Section 341 & 506 and Section 376 of IPC against the son of the complainant and he was arrested on 16.08.2023. Counsel submits that
[2025:RJ-JP:4120] (2 of 3) [CRLMB-15236/2024] subsequently, he was charge-sheeted and bailed out. Counsel submits that after a long time of arrest of the complainant’s son, this FIR has been lodged on 01.04.2024. Counsel submits that petitioner is a lady and she is ready to join the investigation. Custodial interrogation of the petitioner would not served any fruitful purpose. 3. Learned State Counsel as well as counsel for the complainant opposes the submissions made by counsel for the petitioner. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by both the parties, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the bail application. 6. The anticipatory bail application is allowed.
The S.H.O/I.O/Arresting Officer, Police Station Nayapura, District Kota City (Rajasthan) in F.I.R. No.153/2024 is directed that in the event of arrest of the petitioner- Rachna Singh D/o Surendra Singh, she shall be released on bail, provided she furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the petitioner shall make herself available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or
[2025:RJ-JP:4120] (3 of 3) [CRLMB-15236/2024] indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and (iii) that the petitioner shall not leave India without previous permission of the court.
