GP MUNCIPAL ADMN AND URBAN DEV(AP) The Court made the following: THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 24654 OF 2018 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief: “…..to issue a Writ, Order or direction more particularly one in the nature of Writ of mandamus declaring the action of the 3rd respondent in issuing the tender notification in Tender ID 141584, Tender Notice Number 18/2017-18 without exempting the petitioner society from payment of Earnest Money Deposit (EMD) and not reserving at least 15 percent or more of all the works including sanitation works in the 3rd respondent Municipality to the Petitioner Society as illegal, arbitrary and violative of Art 14 and 21 of Constitution of India and opposed to the provisions of A.P.Municipal Tender Rules 3(2), 5(2), 8(3) G.O.Ms.No.475 MA & UD dt 28.8.1989 G.O.Ms.No.581, dt 06.07.1986 G.O.Rt.No.269 MA dt 07.04.1998 and G.O.Ms.No.30 MA & UD (G.II) dt 18.01.2000 and pass such other orders....” 2. Learned counsel for the petitioner would submit that in view of passage of time, the cause in this Writ Petition does not survive for an adjudication by this Court. 3. Recording the submissions made, the Writ Petition is dismissed as infructuous. No order as to costs.
