1. Applicant has filed this second bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail as she has been arrested in connection with Crime No. 269/2023 registered at Police Station – Jutmil, Raigarh, District Raigarh (C.G.) for offence punishable under Sections 201, 120-B and 302 of Indian Penal Code. The first bail application was dismissed as withdrawn vide order dated 29.01.2025 in M.Cr.C. No.763 of 2025. 2. Case of prosecution, in brief, is that one dead body was found on 01.07.2023 at Amlibharna Highway road at about 5:00 pm – 5:30 pm. Dead body was identified to be of one Manish Pandey. Merg was reported to the concerned Police Station, based upon which, crime was registered against unknown person. During course of investigation, applicant was made accused on the basis of memorandum statement of co-accused Sarita Patel and he was arrested on 03.07.2023..
3. After arguing for some time, learned counsel for the applicant submits he may be permitted to withdraw this application, he however submits that as only four witnesses are remaining to be examined, the learned trial Court be directed to expedite the trial.
4. In view of the submission of learned counsel for the applicant, this bail application is dismissed as withdrawn. However, considering the fact that applicant is in jail since 03.07.2023 and only four witnesses are remaining to be examined, the learned trial Court is directed to expedite the trial.
