The order dated 06.12.2019 passed by Special Metropolitan Magistrate (NI Act Cases) No.5, Jaipur Metro, is under challenge in this petition by which the cognizance has been taken against the petitioner under Section 138 of the Negotiable Instruments Act, 1881. Order of taking cognizance is a final order and the same is revisable under Section 397 Cr.P.C. but without filing the revision petition under Section 397 Cr.P.C. before the Revisional Court, the petitioner has straightaway approached this Court by way of filing of the instant misc. petition bypassing the jurisdiction of the revisional authority. 3. In view of the above, the instant misc. petition stands disposed of granting liberty to file revision petition before the Revisional Court under Section 397 Cr.P.C. 4.
