Heard the parties.
The petitioner has been made accused in connection with Jamtara Cyber Crime P.S. Case No.41 of 2025 for the offence registered under Sections 111 (2) (b), 111 (3), 111 (4), 317 (2), 317 (4), 317 (5), 318 (4), 319 (2), 338, 336 (3), 340 (2) and 3 (5) of the B.N.S., 2023 and Section 66 (B) (C) (D) of the Information Technology Act, pending in the court of learned Special Judge Cyber Crime, Jamtara. Bail application of the petitioner was earlier allowed by a Co-ordinate Bench of this Court vide order dated 15.07.2025 on the condition that he will deposit cash security of Rs. 6,76,056/-. The petitioner moved the Hon’ble Apex Court taking a plea that he was not in a position to deposit cash security. Hon’ble Apex Court remanded this case back to this Court for fresh consideration. The petitioner is alleged to have defrauded the victims Sadhna Nitin and Vijay Kapoor to the tune of Rs.25,450/- and Rs.29,998/- respectively. During the course of investigation, the victims have supported the prosecution case that they were defrauded by this petitioner. It was submitted that petitioner is in custody on 21.05.2025. It was further submitted that charge has not been framed in this case. Considering the period of custody, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Special Judge Cyber Crime, Jamtara, in connection with Jamtara Cyber Crime P.S. Case No.41 of 2025.
