This writ petition has been filed with the following prayer:- "i. Issue, a writ, order or direction in nature of mandamus directing/commanding the learned court below to decide the pending Election Petition No.06 of 2023 CNR No. UPM001-006523-2023. (Arshi Parveen Vs. Rubi Parveen and others) pending in the learned court Additional District and Session Judge/ Court No.10 Moradabad expeditiously within a stipulated period;" It is contended that election for Municipal Councilors of Nagar Nigam, Moradabad was held on 13.05.2023 and respondent No.1 was declared elected. The election was challenged by the petitioner through Election Petition No.6 of 2023, which is pending consideration. The sole prayer made in the writ petition is for expeditious disposal of the said election petition. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the private respondents, the matter is being disposed of, at the admission stage, with a direction upon Court conrened to decide the Election Petition No.06 of 2023 (CNR No.UPM001-006523- 2023), after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of six months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
