ORAL ORDER Petitioner is facing trial in S.C.No.132/2021 before the Court of VII Additional District and Sessions Judge, Bengaluru Rural District, Bengaluru, for offences punishable under Section 302, 201 read with Section 34 of IPC.

Learned counsel for the petitioner contended that this Court while rejecting his bail petition in Criminal Petition No.6272/2023 has directed the trial Court to dispose of the matter expeditiously and the said order was passed on 16.08.2023, but as on today the trial is not concluded. It is also contended that the material witnesses have turned hostile and the petitioner is in judicial custody since 25.03.2021.

3. Learned Additional State Public Prosecutor has submitted that the trial is at fag end and only one witness i.e., CW.25 - Investigation Officer has to be examined in this case.
4. The submission made by the learned Additional Special Public Prosecutor is not disputed. Since the trial is at the fag end and considering the charges leveled, petitioner is not entitled for bail.
5. Accordingly, petition is dismissed.
