Criminal Miscellaneous Bail Application No. 15263/2024 Malkit Singh S/o Gurmeet Singh, Aged About 20 Years, R/o Akaliya, Police Station Bhagata Bhaika, Distt. Bhatinda, (Punjab) (Petitioner Is In District Jail Sikar). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Ali Mohd. Khan For Respondent(s) : Mr. Jitendra Singh Rathore, Addl.G.A.
HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 27/02/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 230/2024 registered at Police Station Dhodh, District Sikar for the offence(s) under Section 8/15 of the NDPS Act.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. Counsel further submits that recovered quantity of poppy-straw is 30.160KG which is below commercial quantity. The accused-petitioner is in custody since 16.11.2024, the trial of the case will take considerable time. There are no criminal antecedents against the petitioner, therefore, the benefit of bail may be granted to the accused- petitioner.
(2 of 2) [CRLMB-15263/2024] Per contra, learned Public Prosecutor opposes the grant of bail application. Considering the arguments advanced by the counsel for the parties and looking to the fact that recovered quantity of contraband articles is below commercial. Accused-petitioner is behind the bars since 16.11.2024 and the trial of the case will take considerable time, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused- petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Malkit Singh S/o Gurmeet Singh, in connection with FIR No. 230/2024 registered at Police Station Dhodh, District Sikar shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for her appearance before the court concerned on all the dates of hearing as and when called upon to do so.
