[2025:RJ-JP:6986] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Bail Cancellation Application No. 165/2023 State Of Rajasthan, Through Pp, Rajasthan. ----Petitioner Versus Shubham Mehra @ Devendra S/o Chandramohan, R/o Near Hotel Jagdish, Ladpura, Police Station Kotwali, Kota Rajasthan. ----Respondent For Petitioner(s) : Ms. Arti Sharma, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 21/01/2025 Heard. By way of this application under Section 439(2) Cr.P.C., the petitioner-State of Rajasthan has approached this Court seeking cancellation of regular bail granted to the respondent. The accused-respondent was granted bail by learned Additional Sessions Judge No.2, Kota vide order dated 20.07.2020. Thereafter, the petitioner-State of Rajasthan moved an application under Section 439(2) Cr.PC for cancellation of bail. However, the same was dismissed vide order dated 01.08.2022 after considering the material available on record. Having heard and considered the submissions advanced by learned Public Prosecutor and after going through both the orders passed by learned Court below as well as the FIR, I am of the firm opinion that the impugned orders do not suffer from any infirmity whatsoever so as to call for interference therein. The respondent was granted bail after considering the material available on record by the learned trial court and the bail cancellation application filed [2025:RJ-JP:6986] (2 of 2) [CRLBC-165/2023] by the State of Rajasthan was also dismissed by the learned Additional Sessions Judge after dealing with the submissions advanced before him. Thus, the instant bail cancellation application is dismissed as being devoid of merit. (ANIL KUMAR UPMAN),J Lalit Mohan/82
