[2025:RJ-JP:3364] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 24541/2018 Sohan Singh S/o Govind Singh Rawat, Aged About 65 Years, R/o Mundoti P.s. Beawar Sadar, District Ajmer (Raj.) ----Petitioner Versus 1. State Of Rajasthan Through Principal Secretary, Home Department, Government Secretariat, Jaipur. 2. District Collector, Ajmer. ----Respondents For Petitioner(s) : Ms. Nikita Sharma for Mr. Deshraj Kalwania For Respondent(s) : HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL Judgment / Order 23/01/2025 This writ petition is filed seeking a direction to the respondents to decide the petitioner’s application filed for renewal of his arm licence. Learned counsel for the petitioner submits that he had applied for renewal of his arm licence with the District Collector, Ajmer vide application dated 19.12.2016 and despite lapse of more than eight years thereafter, it is yet to be decided. Inviting attention of this Court towards Rule 13 of the Arms Rules, 2016 (for brevity, ‘Rules of 2016’), she would submit that the maximum period permissible for deciding the application is 60 days after receipt of the police report. She, therefore, prays that the respondents be directed to decide his pending application. Heard. Considered. [2025:RJ-JP:3364] (2 of 3) [CW-24541/2018] From the documents available on record, it is apparent that the petitioner had applied for renewal of his arm licence with the District Collector, Ajmer way back on 19.12.2016 and the police report has also been submitted in his favour in the year 2018. However, the application is yet to be decided. Rule 13 of the Rules of 2016 reads as under: “13. Time limit for grant of licence.- The licensing authority, after considering the application and on being satisfied that the application has fulfilled the eligibility conditions, shall grant or refuse to grant a licence for permissible category of arms or ammunition specified in category III of Schedule I, to any person by recording in writing the reasons for such grant or refusal, by passing a speaking order, within a period of sixty days of the receipt of the police report: Provided that the licensing authority shall specify, the type of arms and ammunition to be procured by the applicant after assessing the reason and the need for possession of the type of arms and ammunition applied for by the applicant, considering its lethality or fire- power.” In view thereof, this writ petition is disposed of in following terms without issuing notice to the respondents to obviate further delay and not to enburden them with unnecessary litigation expenses: “(1) The respondent no.2, District Collector, Ajmer is directed to pass a reasoned and speaking order on the application filed by the petitioner seeking renewal of his arm licence within a period of sixty days from [2025:RJ-JP:3364] (3 of 3) [CW-24541/2018] the date of communication of this order, if not already decided.” Pending application(s), if any, also stands disposed of accordingly.
