The petitioners have been made accused in connection with Bishunpur P.S. Case No. 08 of 2024, Spt. POCSO Case No.16 of 2024, for the offence registered under Sections 376 (DA) & 354 (B) of the Indian Penal Code and Sections 4, 6 & 8 of POCSO Act, pending in the court of learned Exclusive Special Judge, POCSO Court-cum-learned Additional Sessions Judge-IV, Gumla. On 13.05.2024, petitioners and co-accused persons are alleged to have gang raped the victim. Attention has been drawn towards the statements of the victim and her mother recorded during trial, in which, victim has not identified the accused persons and have been declared hostile. In view of the aforesaid fact, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of learned Exclusive Special Judge, POCSO Court-cum-learned Additional Sessions Judge-IV, Gumla, in connection with Bishunpur P.S.
