[2025:RJ-JP:3007] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 15249/2024 Shankar @ Jahrili S/o Late Suresh, Aged About 25 Years, R/o Behind National Gym, Bag Wala Kuwa, Dhobi Ghatta, Police Station Shivaji Park, Alwar. (At Present Accused Petitioner Confined In Central Jail, Alwar). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Gurvindra Singh For Respondent(s) : Ms. Manju Dave, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 21/01/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 325/2024 registered at Police Station Shivaji Park, District Alwar for the offence under Sections 305(a) of BNS.
Learned counsel for the petitioner submits that the accused petitioner has falsely been implicated in this case. Learned counsel further submits that recovery of stolen article i.e. E-rickshaw was effected from co-accused Taufeeq who has already been enlarged on bail by the trial court vide order dated 26.11.2024 and no recovery of any stolen articles were effected from the possession of the petitioner. The earlier bail application of the accused- petitioner was dismissed solely on the grounds that petitioner is having 24 criminal cases registered against him. Offences alleged
[2025:RJ-JP:3007] (2 of 3) [CRLMB-15249/2024] to have been committed by the petitioner are triable by Magistrate. Counsel further submits that the accused-petitioner is in custody since 21.11.2024 and trial of the case will take considerable time. Police has already submitted the charge-sheet, therefore, the petitioner may be enlarged on bail. Per contra, learned Public Prosecutor opposed the grant of bail application. Heard and perused the material available on record. Considering the arguments advanced by the counsel for the parties and looking to the fact that charge sheet has already been produced before the concerned court and E-rickshaw alleged to be stolen was recovered from the possession of the co-accused i.e. Taufeeq who has already been enlarged on bail by the trial court, and case of the petitioner is triable by Magistrate, therefore, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Shankar @ Jahrili S/o Late Suresh, in connection with FIR No. 325/2024 registered at Police Station Shivaji Park, District Alwar shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge. The accused- petitioner is also directed to mark his presence on 25th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station shall send the presence report of the accused petitioner to the trial court every month. In case of any breach to the above condition, the
[2025:RJ-JP:3007] (3 of 3) [CRLMB-15249/2024] learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned Magistrate.
