(Oral) Petitioners have filed the present petition, under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, (hereinafter referred to as ‘BNSS’), for quashing of FIR No.104 of 2022, dated 22.06.2022, registered under Sections 3(1(s), 3(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, (hereinafter referred to as the SC&ST Act) and Sections 323, 504 & 34 of Indian Penal Code, (hereinafter referred to as the ‘IPC’), 1 Whether reporters of Local Papers may be allowed to see the judgment? 2. ( 2025:HHC:39769 ) with Police Station, Aut, District Mandi, H.P., as well as, proceedings resultant thereto, pending before the Court of learned Sessions Judge, (Family Court) Mandi, District Mandi, H.P. (hereinafter referred to as ‘trial Court’). 2. The relief of quashing has been sought on the basis of the compromise, effected between the parties. 3. According to the petitioners, on the statement of respondent No.1, the FIR, in question, has been registered against them. 4. According to the petitioners that the FIR in question was registered at the instance of respondent No.1, in which he has falsely been implicated. He had alleged that on 22.06.2022, on account of trivial matter, a scuffle had taken place between petitioners and respondent No.1. 5. After registration of the FIR, the police has conducted the investigation and filed the charge sheet, which has been pending before the learned trial Court. 6. On the basis of the said compromise, a prayer has been made to allow the petition, as prayed for, by quashing of FIR No.104 of 2022, as well as, all the proceedings resultant thereto, which are pending before the learned trial Court. 3. When put to notice, respondent No.2-State has filed the status report, disclosing therein, that on 22.06.2022, respondent No.2-Krishan Pal, Son of Shri Kehar Singh, R/o village Jhiri, P/o Nagwain, Tehsil Aut, District Mandi, H.P., came to Police Station Aut, for registering the case and stated that he is doing rafting work in Jhiri. On 22.06.2022, he was sitting at his counter, then at about 5:30 PM, Neetu, Bunty, Pawan and two other persons entered his counter, and they abused respondent No.2 without any reasons (caste creed) threatened to kill and they beat up with a grip in their hand. Due to which, respondent No.2 had sustained serious injury near his right eye and has prayed that action be taken against the accused persons, in which, the FIR, in question, has been registered and the manner, in which, the police has investigated the matter. 8. The person, who, at one point of time, has levelled the allegations against the petitioners and has lodged the FIR, in question, appeared today, before this Court and made a statement, on oath, that on trivial matter a scuffle had taken place and he had lodged an FIR, in question, against the petitioners. 4. ( 2025:HHC:39769 ) basis of the compromise, a prayer for quashing of the FIR in question has been made. 9. Similar type of statements have been made by the petitioners, on oath. 10. Heard. 11. As per the stand taken by the parties, the dispute between them has now been settled. The terms and conditions of the settlement, have been placed on record, vide Annexure P-2. 12. The criminal machinery, in the present case, has swung into motion, by respondent No.1, by lodging the FIR, in question. However, as per the stand, taken by the petitioners, as well as, respondent No.1, they have compromised the matter, vide Annexure P-2. 13.
Even otherwise, acceptance of the compromise will also save the precious judicial time of the learned trial Court, which the learned trial Court would be in a position to devote such time in deciding some other serious disputes, pending before it. 14. Considering all these facts, the present petition is allowed and FIR No.104 of 2022, dated 22.06.2022, registered, under Sections 3(1(s), 3(va) of the Scheduled

The compromise deed, as well as, statements of the parties, recorded today shall form part of this order. 16. The present petition is allowed in the aforesaid terms.
