The petitioner has been made accused in connection with S.T. No.156 of 2022 arising out of Kuru P.S. Case No. 133 of 2018, for the offences registered under Section 302 of the I.P.C., pending in the court of learned Additional Sessions Judge-I, Lohardaga. On 13.10.2018, the petitioner is alleged to have assaulted his brother by a log, due to which he succumbed to his injuries. It was submitted that the occurrence took place due to free fight between the petitioner and the deceased. It was further submitted that petitioner had assaulted his brother at the spur of the moment. It was further submitted that even assuming the entire allegation to be true, this case will be made out under Section 304 part-II of the I.P.C. It was also submitted that petitioner is in custody more than three years. In view of the submissions made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-I, Lohardaga, in connection with S.T.
