Surinder Singh Vs. State of H.P. and Others2 was instituted by the petitioner seeking to count his service rendered w.e.f. 08.11.2006 towards seniority for all intents and purposes. The said service was rendered by the petitioner as Parent Teacher Association (PTA) appointed teacher. Respondents regularized the services of the petitioner w.e.f. 1 Whether reporters of Local Papers may be allowed to see the judgment? 2 CWP No.1794 of 2018 decided on 08.10.2018 - 2 - 05.08.2022 vide Annexure P-8. 3. Petitioner has filed this writ petition seeking regularization of his services w.e.f. 01.04.2018 at par with other PTA appointed teachers in light of decision rendered in Yashwant Singh and others Vs. State of HP and others3 and Saroj Devi Vs. Stat eof HP and Anr.4 4. The substantive reliefs prayed for the petitioner read as under: - “i). Issuing a writ of mandamus to direct the respondents to regularize the services of the petitioner w.e.f. 01.04.2018 at par to the others PTA teachers in view of the judgment rendered by this Hon'ble Court in CWP No. 342 of 2021 titled as Yashwant Singh vs State of HP, and by counting the period of 19-09- 2008 to 11-09-2013 is liable to be counted towards his service as per the decision of this Hon'ble Court in CWP 1794 of 2018 and CWP No. 2309 of 2016 titled as Saroj Devi Vs State of H.P. and service of petitioner is to be counted w.e.f. 03-11-2006 with all the consequential benefits for all intent and purposes. ii) Issue an appropriate writ, order or direction to the Respondents to fix the pay of the Petitioners accordingly and to calculate & pay arrears of salary consequent upon regularization of service w.e.f 01.04.2018 along-with seniority etc. in service. ” 3 CWP No. 342 of 2021, decided alongwith connected matters on 31.08.2022 4 CWP No.2309 of 2016 decided alongwith connected matter on 04.05.2017 - 3 - Learned counsel for the petitioner states that the petitioner would be content, if the case of the petitioner is considered by the respondents in light of the aforesaid judgments. Learned Additional Advocate General has no objection to this prayer. 5. Having regard to above submissions and without examining the merits of the matter, this petition is disposed of by directing the respondents to consider the case of the petitioner in light of the aforesaid judgments and pass appropriate orders in accordance with law within a period of six weeks from today.
