Thus, in our view Rule 14 sub-rule (a) which prohibits release of a prisoner who is resident of outside the State of Rajasthan in comparison to local prisoners on parole makes a discrimination on the geographical ground and as such it is per se discriminatory. Thus, the Rule 14 sub-rule (a) only to the extent,
"Persons whose ordinary place of residence is outside the State of Rajasthan" is ultra vires of the Article 14 and 21 of the Constitution of India. The authorities while considering the case of prisoner whose ordinary place of residence is outside the State of Rajasthan can enquire into the conduct of the convict more intensively but with the sense of urgency and within the stipulated period. Reasonable conditions can be imposed for the return of the convict to jail to serve out the remaining part of the sentence." Rule 3(a) of the Rules of 1972 is para meteria to Rule 14 aforesaid, and therefore, the reasons given to declare Rule 14 of the Rules of 1958 are applicable in present case too mutatis mutandis. In view of this position of law we are of the view that Rule 3(a) of the Rules of 1972 is bad being in violation of Article 14
, 15 and 21 of the Constitution of India.

[2025:RJ-JP:37036] (5 of 6) [CRLW-2146/2024] we are of the considered opinion that the classification of the prisoners made under Rule 3(m) of the Rules of 1972 on basis of marital status is a irrational and is having no nexus with the object sought to be achieved by the Rules of 1972. The classification impugned is discriminatory and arbitrary too and as such i.e. in violation of Article 14 of the Constitution of India. The Rule concerned, therefore, is declared bad and as such is set aside. bl izdkj mDr U;kf;d fofu'p; esa ;kph ds vfookfgr gksus ds vk/kkj dks voS/k ?kksf"kr fd;k x;k gSA izkFkZuk&i= fujLr djus dk rhljk vk/kkj ;g vafdr fd;k x;k gS fd ;kph@canh nks ls vf/kd rhu ekeyksa esa nks"kfl) fd;k x;k gS vkSj blh dkj.k fu;e 3¼,Q½ ds varxZr [kqyk canh f'kfoj esa Hksts tkus dk ik= ugha gSA bl lEcU/k esa lEcfU/kr fu;eksa dk v/;;u djus ls izdV gksrk gS fd fu;e 3 jktLFkku dSnh [kqyk canh f'kfoj 1972 esa lkekU;r% ¼ordinarily½ 'kCn dk iz;ksx fd;k x;k gS] ftldk vfHkizk; ^^vko';d ugha^^ ¼not necessarily½ ds :i esa fuoZpu djrs gq, bl U;k;ky; dh [k.MihB us vius U;kf;d fofu'p; lqHkk"k pan&cuke&jktLFkku jkT; [k.MihB flfoy fjV ;kfpdk la[;k 12020@2013 esa fuEu izdkj ls izs"k.k fd;k gS&
10. Since Rule 3 of the Rules of 1972 has already been considered and the word 'ordinarily' has already been interpreted as 'not necessarily', therefore, respondents cannot refuse to accept and consider the applications of the petitioners, subject to other conditions. The present matters are fully covered by decisions of this Court in Krishna & Anr. Vs. State of Rajasthan (supra) & Geeta Devi Vs. State of Rajasthan (supra).
